A club is organised around members
In Valencia, cannabis-club language commonly refers to an association. Under Spain’s general association law, its statutes define purposes, membership and governance. The general assembly is the highest governing body, and members have information and participation rights. This is an organisational relationship: someone belongs to a body with rules and responsibilities. It differs from an ordinary shop transaction, in which a customer buys a product without becoming part of the seller’s governance.
A CBD shop follows product categories
CBD retail brings another set of questions. Food, cosmetics and medicines have different regulatory requirements, even when they mention the same ingredient. AESAN’s 2026 position remains that CBD is not authorised as a novel food. A cosmetic ingredient’s appearance in the European CosIng database is also not a product approval: the database is informational. Consequently, the phrase CBD shop does not describe a single licence covering every possible use of cannabidiol.

Medicinal dispensing has a defined pathway
Royal Decree 903/2025 and the 2026 AEMPS monograph establish a hospital framework for certain standardised cannabis preparations. Hospital specialists and pharmacy services have specified prescribing, preparation, dispensing and monitoring roles. This is different from a cannabis association or general retail outlet. A therapeutic-sounding product name does not create those clinical responsibilities or place its seller inside the hospital system.
Why the word dispensary can mislead
California’s Department of Cannabis Control issues distinct retail licences: Type 10 for storefront retailers and Type 9 for non-storefront retailers, alongside local requirements. Spain’s association registration has no equivalent retail function. A Valencia association organises members under its statutes; a lawful CBD business is subject to the rules for its particular products; a hospital pharmacy provides medicinal care. These are separate institutions with different responsibilities.
