A holiday is not a membership category
Spanish association law leaves admission conditions and member rights to the statutory framework and the organisation’s statutes. It does not establish a universal tourist category for cannabis clubs. An invitation describes a relationship with an organisation; it is not a national cannabis licence. Membership can create participation, information and voting rights under the statutes, but the association cannot rewrite the law applying to its activities.
Public space remains a separate setting
Article 36.16 of Organic Law 4/2015 covers illicit possession or consumption in public places, streets, establishments and collective transport, even without trafficking intent. A journey between private premises therefore has its own legal context. The provision does not make visitor status an exemption. It is the alleged public conduct that matters, rather than whether someone possesses a membership card or has previously entered an association.
Supply questions belong to criminal law
Article 368 of the Criminal Code concerns unlawful cultivation, manufacture, trafficking and conduct promoting or facilitating illegal consumption. That framework is separate from both the general freedom to form associations and administrative public-possession rules. The distinction prevents a common misunderstanding: a private organisational setting does not automatically determine the legality of everything occurring inside it. Actual conduct and its evidence remain central.
Prescribed medicines have a travel procedure
AEMPS guidance updated 28 August 2026 sets a separate procedure for travellers carrying controlled medicines as part of medical treatment. For cannabis or derivatives entering Spain, the maximum permitted amount corresponds to 15 days of treatment; applications require at least ten days’ advance submission with the required documentation. These are medical-travel rules, not club-membership rules. Their existence explains why a lawful prescription and an authorised travel document occupy a different legal category from an association invitation.
